Fujitsu's Wandant dog pedometer tracks your pet's moves, uploads it to the cloud

There's a whole host of techy tools that will let you log your 10k personal best, and break down your splits into minute detail, but what about poor old Rover? Fujistu spotted this gap, and created Wandant -- a sensor-laden neck tag for dogs complete with cloud-based service for tracking your pooch's wellbeing. The hardware will log your pet's footsteps, amount of shivering plus temperature change, and upload it automatically via your smartphone or PC. The software will present you these data over time, with the option of manually inputting further details such as food amount, a diary with photos and -- for those with stronger constitutions -- stool condition. Like human-focused equivalents, there will also be provisions for sharing your dog's efforts, but thankfully only with vets and research institutions. There's no details on hardware pricing just yet, but the online component is free for the first year (JPY 420 / about $5 per month there after). Money no object for your mutt? Sadly only available in Japan for the time being, so you'll need to include a return ticket in that splurge too.

China paper carries Onion spoof

The online version of the Chinese Communist Party's official newspaper appears to have fallen for a spoof by the US satirical website, The Onion.

The People's Daily ran a 55-page photo spread of North Korean leader Kim Jong-un after he was declared The Onion's Sexiest Man Alive for 2012.

He is shown riding horses, holding children and greeting his troops.

The spread is accompanied by tongue-in-cheek quotes from The Onion about the "Pyongyang-born heart-throb".

"With his devastatingly handsome, round face, his boyish charm, and his strong, sturdy frame, this Pyongyang-born heart-throb is every woman's dream come true," the People's Daily quoted The Onion as saying.

"Blessed with an air of power that masks an unmistakable cute, cuddly side, Kim made this newspaper's editorial board swoon with his impeccable fashion sense, chic short hairstyle and, of course, that famous smile."

Chinese social media reaction

Li Kaifu, freelance journalist, on Tencent Weibo says: "It's amazing that the People's Daily doesn't know that the Onion is a satirical website. Now they are the laughing stock of the world media."

On Sina Weibo, internet user Yang Tuer writes: "All the People's Daily did was to carry this satire, and if the readers take it seriously, that's their problem. What People's Daily did wrong was to publish such meaningless content. They brought it on themselves."

Maoxu on Tencent Weibo says: "It serves them (People's Daily) right. They think a joke about Kim Jung-un is serious news. I hope the editors will now stop playing video games at work, and start looking at the world, and improving their standard. What a joke."

"I wouldn't say I'm surprised," Onion editor Will Tracy told the BBC, responding to the People's Daily feature.

"I mean, this kind of thing has happened in different forms before, so it never totally takes us by surprise, although it's a total delight whenever it does happen."

The Onion, which ran its Sexiest Man Alive piece earlier in the month, had an update to its article on Tuesday.

"For more coverage," it wrote," please visit our friends at the People's Daily in China, a proud Communist subsidiary of The Onion, Inc. Exemplary reportage, comrades."

Paper trail

By around midday on Wednesday, the People's Daily spread appeared to have been removed, with the link to the English version returning an error message.

Yuwen Wu of BBC Chinese says after The Onion published the spoof on 14 November, the story was picked up by the Hong-Kong based ifeng.com. It published a Chinese version on 21 November - but with readers' comments and a clear explanation about the satirical nature of the Onion site.

A Chinese website, Yangzi Wanbao (Yangtse Evening Daily), published a shorter version of the story on the same day, citing ifeng.com as the source, but without the crucial explanation about The Onion.

Guangming Daily then carried the story on 26 November, quoting the Yangtse Evening Daily. The People's Daily in turn published the story on 27 November, citing Guangming Daily as its source.

The Onion said previous winners of its Sexiest Man Alive prize included Syrian President Bashar al-Assad and US financial swindler Bernard Madoff, who is currently serving a 150-year prison sentence.

Two months ago, Iran's semi-official Fars news agency was forced to apologise after being taken in by a spoof news item from The Onion which declared rural Americans preferred Iranian President Mahmoud Ahmadinejad to US President Barack Obama.

It quoted one fictional West Virginian resident as saying he would rather go to a baseball game with Mr Ahmadinejad because "he takes national defence seriously".

Dubai back in mega-project mood after fiscal dive

DUBAI, United Arab Emirates (AP) ? Dubai is suddenly rediscovering its old habits.

That means relentless hype and construction plans loaded with superlatives. Case in point: A proposed Taj Mahal replica four times bigger than the original.

Leaders, too, are back swaggering with a mojo that seems aimed to wipe away memories of the city's humbling fiscal collapse just three years ago.

"We do not anticipate the future," said Dubai's ruler Sheik Mohammad bin Rashid Al Maktoum in announcing plans Sunday for a new "desertopolis" that will bear his name. "We build it."

It all rings very familiar. The same type of super-charged ambition reshaped Dubai beginning in the 1990s and left an impressive legacy including the world's tallest skyscraper, a villa-studded island shaped like a palm, malls packed with top retailers and tourist and business networks that are the envy of the Middle East.

But it also helped drive the emirate over the edge.

The global financial crisis smacked Dubai particularly hard after years of increasingly shaky construction funding schemes, where state-linked developers often used money collected for one unfinished project to start another. As credit dried up, the deeply indebted Dubai government had to scale back sharply just to meet its bills. It took a $10 billion bailout from oil-rich neighbor Abu Dhabi in 2009 just to give it some breathing room to begin selling off assets and negotiating with creditors for billions more owed by the city-state.

Now ? with another generation of outsized projects on the drawing boards ? some are questioning whether the pre-bust creed of bigger-is-better still makes sense in a more cautious world.

The Great Recession pummeled the type of high-risk investors who would once sink money into a project that was still just a plot of sand and desert brush.

But Dubai is still betting heavily on long-term appetite for the kind of self-contained, mega-scapes that were among the main casualties of its fiscal meltdown. The new wave of projects also marks an important shift for Dubai away from housing-oriented developments toward more entertainment and tourism, particularly with visitors from China sharply on the rise. The proposed Mohammad bin Rashid City ? named after Dubai's ruler ? includes a shopping complex that will surpass the world's largest, the Dubai Mall, just down the road.

Nick Maclean, the managing director of property advisers CB Richard Ellis Middle East says the investment climate is on the rebound. Dubai's economy grew a healthy 4.1 percent for the first six months of 2012 compared with the same period last year, officials said Monday. But Maclean and others still cast wary eyes on frontier areas such as desert outskirts where many of the giant projects are planned.

"We tell developers that the time is not right for them to build speculatively because we see very limited demand," he said in an interview this month with Big Project Middle East, which follows major development initiatives in the region.

Consider the marketing push ahead for the proposed satellite city: 100 hotels, a theme park in collaboration with Universal Studios, a green space somewhere in size between London's Hyde Park and New York's Central Park, and the mother of all malls.

But there's no lack of confidence from its namesake. "The current facilities available in Dubai need to be scaled up in line with the future ambitions of the city," said Dubai ruler Sheik Mohammad.

Another planned development ? literally just over the horizon ? delves even deeper into the Dubai's penchant for alternative realities such as an indoor ski slope or an archipelago shaped liked the world's continents.

The lavishly named Falconcity of Wonders was first unveiled during the height of Dubai's white-hot growth five years ago, but later fell victim to the financial crisis. It's now back on the agenda with ethnic-themed sections that include replicas of the Eiffel Tower, the Giza Pyramids and the leaning Tower of Pisa.

So far, the only significant outrage from abroad is over a proposed version of the Taj Mahal ? the "Taj Arabia" ? that's four times larger than the original in Agra south of New Delhi.

"It is patently wrong and absurd," a former Agra legislator, Satish Chandra Gupta, told Indian media.

The developers, however, predict it will be a major draw for wedding parties among Dubai's large Indian community and growing tourism from the subcontinent.

The Indian outreach doesn't end there. A Bollywood theme park is part of a $2.7 billion five-park complex announced Monday by the office of Dubai's ruler. It also seems to be Sheik Mohammad's grand response to the fiscal nosedive that shutdown plans for several theme parks, leaving more than one colorful gateway-to-nowhere in the desert.

"Hubris," said Christopher Davidson, an expert on Gulf affairs at Britain's Durham University, referring to the blitz of new mega-projects.

Vulgar Twitter Conversation: Singer Chris Brown vs. Follower - Fox 4

(CNN) ? Chris Brown has deleted his Twitter account after getting into a vulgar war of words with comedian and writer Jenny Johnson on Sunday.

The stomach-churning exchange of messages all began with Brown tweeting, ?I look old as f***! I?m only 23,? and Johnson responding, ?I know! Being a worthless piece of s*** can really age a person.?

The back-and-forth between Brown and Johnson, some of which can be seen on Johnson?s still-public feed, continued for at least half-an-hour. Brown bit back at Johnson?s initial reply with a derogatory comment referencing oral sex, to which Johnson readily corrected his spelling.

From there, Brown made a lewd comment about farting, to which Johnson replied, ?Your mom must be so proud of you.? She also posted a link to a 2009 MTV News story containing details of Brown?s assault on his then-girlfriend Rihanna.

After another round of scatological chatter, both Johnson and Brown seemed to give in.

?Okay. I?m done,? Johnson wrote, later adding, ?I have zero respect for a person who seems unapologetic for the terrible crime he committed and shows no signs of changing.?

Before shutting down his Twitter account, Brown told his fans, ?To teambreezy? Know that I?m not upset. Just felt like entertaining the ignorance ? Further proved my point of how immature society is. #CarpeDiem. Catch me in traffic ??

Since the Twitter spat, Johnson has reported receiving threatening messages.

?It?s alarming how many death threats I?m receiving via replies,? she tweeted Monday. ?I encourage everyone, including Twitter to look through them. Not cool.?

Brown, meanwhile, had encouraged Johnson to ?Just ask Rihanna if she mad??????,? which wouldn?t appear to be the case. The pair, who announced their renewed friendship in October and have collaborated together on a song for Rihanna?s new album, ?Unapologetic,? were reportedly spotted in Berlin over the Thanksgiving holiday.

The Estate Planning Information Blog: Avoiding the Nursing Home ...

A recent?New York Times article?explains how new technology is being used to help ensure the safety and health of elderly individuals who live at home. One such technology, called ??eNeighbor,? a system of sensors that are placed all over the home, is used to monitor the movements of elderly citizens and alert emergency responders if any non-typical movements occur, or if usual movements do not occur. The article relates the story of Bertha Branch to illustrate how eNeighbor works. Bertha is 78 and lives alone in her home. One morning, a wireless sensor under her bed detected that she had gotten out of bed, but other sensors in the house registered that she had not been to any of the other rooms in the house, including the bathroom attached to her bedroom. After it became clear that either Bertha was standing in the same spot when she normally would have already visited her bathroom or had fallen, eNeighbor system made phone calls to neighbors, family, and finally to 911. When firefighters arrived, Bertha had been on the floor, where she had fallen and found herself unable to get up, for less than an hour.

Other systems are used to remind and assist people in checking their vitals each day. The same machine can assess and record your weight, blood pressure, temperature, and send all of the information to a monitoring program. If your vitals show evidence of a risk to your health, a nurse from the monitoring program will call you and ask that you see your doctor right away. These, and other technologies also remind you to take medications, and ask questions that prompt new instructions. Machines may, for example ask questions like: ?Are you experiencing more difficulty breathing today?? or ?Are your ankles more swollen than usual??

Of course, technologies like eNeighbor are new and unproven. They are also often expensive and are not yet covered by government benefits or private insurance plans.?Doctors are also not yet trained to treat patients using remote data, and currently have no mechanism to be paid for doing so. And like all technologies, the devices ? including motion sensors, pill compliance detectors and wireless devices that transmit data on?blood pressure, weight, oxygen and glucose levels ? may have unintended consequences, substituting electronic measurements for face-to-face contact with doctors, nurses and family members.?

But as similar technologies become more mainstreamed and dependable, they could be used to help ensure a higher quality of life for elderly citizens who live at home, and could allow them to stay at home much longer than they would have been able to before such technology existed.

Difference between Cloud Based Phone System and Business ...

Business telephone system

Business telephone system generally has multiple extensions to facilitate all key employees of an organization to intercommunicate amongst themselves and make outbound calls to suppliers, field personnel, customers and other stakeholders. The simple fact is a business telephone system is indispensible for any enterprise regardless of its size and scale of operations.

Present day business phone systems have several standard as well as advanced optional features such as Auto Attendant, Speed Dialing, Conferencing, Call Forwarding, Find-me-follow-me, Do not Disturb, Call Transfer, Toll-Free Numbers, Caller ID Blocking, Multi-Ring facility, Distinctive Ringing, Enhanced Voicemail, Area Code Selection, Anonymous Call Block etc.

A business phone system can range from a key pad system meant for small businesses to an intermediate hybrid system to a PBX (private branch exchange) for large corporations.

Business telephone systems can function using the PSTN (Public Switched Telephone Network) and/or over the Internet (called Internet telephony or VoIP). Business phone systems can also be availed as a hosted PBX system - where the entire hardware will be located at the service provider's place. The major advantage of a Hosted PBX is the user need not invest in the equipment nor bother about managing and maintaining the system.

Perhaps you can also consider adding unified messaging and online fax facility. The onus is on you to select the right business phone system that will help your employees to make become more efficient and improve their productivity.

Cloud Based Phone System

Cloud based phone system is the latest innovation and it simply means phone service that is delivered through the internet.

In today's highly competitive scenario, business enterprises to stay and thrive should completely focus on business developmental activities and not waste time in less productive work like managing and maintaining the communication system.

Cloud PBX recognizes this fact as it is Internet-based voice and data communications and all telecommunications applications, switching and storage are hosted by a third-party service provider at his premises. Cloud PBX has all the features of a traditional telephone system and a lot more. One more valid reason why companies may opt for a Cloud based phone system will be the cost factor.

The Cloud based phone system has the potential to deliver calls over the internet, route incoming calls to the right extension within a company, and provide all standard as well as advanced telephone features including voicemail and call recording.

A major benefit of Cloud-PBX is scalability. You can initially buy the basic system and add extensions and optional advanced features as your business grows. As Cloud PBX uses the internet, you can have a telephone connected to the Cloud PBX sans geographic boundaries. A Cloud PBX phone system also allows users to get connected to VoIP handsets.

The concept of Cloud PBX has truly caught on amongst the business community and there is a sourt in the number of Cloud PBX service providers.

The concept of Cloud PBX has truly caught on amongst the business community and there is a spurt in the number of Cloud PBX service providers. In view of this, you can expect competitive pricing and efficient 24X7 service.

Divers, cadaver dogs search for missing teen

By NBC News staff

Updated at 11:11 a.m. ET -- A dive team from the New Mexico State Police was resuming its search near the dam at Vallecito Reservoir on Monday for Dylan Redwine, a 13-year-old boy who disappeared from his father's home during a court-ordered visitation over Thanksgiving in southwestern Colorado.

La Plata Co. Sherrif's Dept.

According to The Durango Herald, the divers began the search Sunday in an area that cadaver dogs had flagged Saturday while aboard watercraft.

No remains had been found by Monday morning.

Cadaver dogs and patrols were also going out around the 12 miles of shoreline, La Plata County Sheriff?s Office spokesman Dan Bender told NBC News on Monday.

"It's been devastating for the family," Bender said.

Dylan was reported missing on Nov. 19 by his father, Mark, who said he left the house in Vallecito, La Plata County, about 7:30 a.m. and returned a few hours later to find his son gone.?

Boy, 13, missing in Colorado after court-ordered holiday visit

Dylan was described as 5 feet tall, 105 pounds, blond hair, blue eyes with a fair complexion.?He was last seen wearing a blue and white Duke Blue Devils baseball cap, a black Nike T-shirt, black basketball shorts, black Jordan tennis shoes and a black backpack.

On Saturday, about 200 volunteers and law enforcement officials went door to door in the region and?searched hills near Vallecito Lake, the Denver Post said.

"Every time someone sees a young male child with light hair or with a black backpack we're getting calls," Bender said, adding that there had been no confirmed sightings of Dylan.

The Herald said police are also looking to speak with two boys who were seen by a postal worker on Nov. 19 at the Vallecito Lake Country Market, according to Bender.

The postal worker, who knows Dylan, said one of the boys looked like him, adding that both teens were also wearing black backpacks. As of Monday morning, Bender said police had not heard from the two boys.

According to a news release, the La Plata County Sheriff?s Office is ?working with local representatives of the FBI to share information and resources as they continue to develop leads on where Dylan may be," The Herald reported.

?Scenarios from abduction to runaway are being examined,? the release said. ?Without any new clues, we have to continue to consider any and all possibilities." The FBI has not officially taken over the investigation, Bender told NBC News.

Dylan, his mother and his brother had moved to Colorado Springs this summer, NBC station KUSA of Denver reported.

Vallecito is more than 7,000 feet above sea level in the middle of rugged terrain. The weather in the area in the past few days has been clear and cool, with highs in the 50s and lows below freezing.?

Anyone with information on Dylan's whereabouts is asked to contact La Plata County Sheriff's Office investigators at 970-382-7015 or 970-382-7045.

Holiday Party Tips - Business Insider

A lot of preparation goes into throwing a holiday party in your home, especially when your family is invited.?

Here are five of the smartest party planning tips we've come across this holiday season.

  • Mix and match your plates and silverware: Mixing and matching is in, according to The LA Times, so embrace it! If you don't have a full set of matching plates and glasses, don't stress. Just alternate settings by seat so the table seems balanced.?

  • Make a signature holiday cocktail: Most people actually don't like having endless drink options at a party, according to Marie Claire. Guests will gladly try something new, especially when it's right in front of them. So skip the full bar, and stock up on wine, beer, and one premade cocktail.?

  • When someone offers to bring something, say yes: Your family probably has a few signature favorites during the holidays. If Aunt Joan's homemade pumpkin pie is the best, let her bake it and bring it when she offers. It's a time-tested favorite, and cuts down on your prep time.

  • Obey the one-bite rule: House Beautiful suggests keeping appetizers to the size of a single bite. That way guests will be able to keep their hands free and sample everything you serve.

Don't forget to serve water: The last thing anyone wants is a drunken family holiday fight. Serving water to keep guests from getting too tipsy, suggests Apartment Therapy.

Supreme Court struggles over workplace harassment standard

WASHINGTON (Reuters) - Fourteen years after deciding that employers can be liable for workplace harassment by supervisors they employ, the U.S. Supreme Court on Monday appeared to struggle with an issue left unanswered: who qualifies as a supervisor.

A decision in the case against Ball State University, brought by a black catering assistant named Maetta Vance, could clarify how readily harassment victims may hold deeper-pocketed employers accountable under federal law.

Several justices questioned where best to draw the line, a task made harder by the agreement of the parties arguing in court that the standard set by the 7th U.S. Circuit Court of Appeals in Chicago in dismissing Vance's case was too strict.

In that June 2011 ruling written by Judge Diane Wood, considered one of its more liberal members, the 7th Circuit said that to be a supervisor, an employee must have the power to hire, fire, demote, promote, transfer or discipline the victim.

Three federal appeals courts have adopted this standard, while three others have said day-to-day oversight is enough to result in liability. A definition proposed by the Equal Employment Opportunity Commission resembles the latter standard.

At Monday's oral argument, Chief Justice John Roberts suggested to Vance's lawyer Daniel Ortiz that the 7th Circuit standard might prove workable.

He posed a scenario in which the most senior of five employees assigned to work in a single room gets to choose the background music, and tells a colleague: "I know you don't like country music; if you don't date me, it's going to be country music all day long.

"I would have thought, under your theory, that means that senior employee is a supervisor," Roberts said. "I would have thought the benefit of the 7th Circuit was that you don't have to go on a case-by-case basis."

Some justices suggested other scenarios, including whether a person becomes a supervisor by having authority to control a thermostat, or decide which employee must work in the only office without air conditioning.

In contrast, Justice Elena Kagan suggested that the 7th Circuit test might be too lenient on employers.

She said, for example, that a university could be freed from liability if a professor subjected a secretary to "living hell, complete hostile work environment on the basis of sex," solely because the secretary could not be fired by the professor, but rather by the head of secretarial services.

SLIDING SCALE

Vance, a black catering assistant at Ball State in Muncie, Indiana, who prepared everything from boxed lunches to formal dinners, had claimed she faced racial epithets and threats of physical harm at work.

Many of her problems stemmed from her dealings with Saundra Davis, a white woman she viewed as a supervisor. She said general manager Bill Kimes, also white, did not protect her and treated other workers better.

Vance said Ball State eventually retaliated against her complaints by making her a "glorified salad girl" who cut vegetables and washed fruit, despite a recent promotion.

Justice Samuel Alito suggested that this might not be enough to subject Ball State to liability.

"What is the most unpleasant thing that Davis could have assigned?" he asked. "Chopping onions all day, every day?"

Ortiz said the standard was not that precise, and that courts would have to use a "sliding scale of negligence" to review harassment claims.

He said a person who oversees a victim's work and can "instill either fear into the victim (or) control the physical location of the victim" would qualify as a supervisor.

INCOMPLETE ANSWER

Gregory Garre, arguing for Ball State, said the 7th Circuit standard was not a "complete answer," and that a harassing employee whose control of a victim's work meaningfully aided the harassment could subject an employer to liability.

But he said that Davis, under any definition, did not qualify as a supervisor, and therefore that Vance must lose.

With the parties in agreement that the 7th Circuit test was too restrictive, some justices suggested possible concern about having taken the case to begin with, given that the Supreme Court does not generally issue "advisory" opinions.

Alito asked "why shouldn't we just remand" to more fully develop the record, while Justice Antonin Scalia said, "There's nobody here defending the 7th Circuit" in the courtroom.

The federal government officially supported neither party, suggesting that the similar standards proposed by the EEOC and the 2nd U.S. Circuit Court of Appeals in New York might be appropriate.

"Control over daily work activities is where we would draw the line," Deputy Solicitor General Sri Srinivasan said.

Several women's and civil rights groups supported Vance's appeal, while the U.S. Chamber of Commerce, the National Retail Federation and various conservative groups supported Ball State.

A decision is expected by the end of June.

The case is Vance v. Ball State University, U.S. Supreme Court. No. 11-556.

Oil prices fall as Israel-Hamas truce holds

(AP) ? The price of oil fell Monday as a truce between Israel and the militant group Hamas that stopped fighting in the Gaza Strip appeared to hold despite a confrontation late last week.

Benchmark oil for January delivery was down 33 cents to $87.95 per barrel at midday Bangkok time in electronic trading on the New York Mercantile Exchange. On Friday, the contract rose 90 cents to close at $88.28 a barrel on the Nymex after Israeli troops fired on crowds in Gaza surging toward a border fence, killing one Palestinian.

Prior to the shooting, oil prices had been falling, thanks mostly to optimism that the cease-fire agreement between the two sides would prevent a broader conflict in the region that could disrupt crude supplies. The truce was struck last Wednesday to end to an eight-day Israeli offensive against Gaza militants who had fired rockets into Israel, but remains fragile.

Traders were also keeping a close eye on developments in Egypt, said independent oil analyst Stephen Schork. Egyptian President Mohammed Morsi on Sunday moved to grant himself near-absolute power, sparking street clashes between his supporters and opponents.

Brent, which is used to set prices for many international varieties of oil, fell 33 cents to $111.05 a barrel.

Other futures on the New York Mercantile Exchange:

? Wholesale gasoline lost 0.2 cent to $2.719 a gallon.

? Natural gas lost 5 cents to $3.851 per 1,000 cubic feet.

? Heating oil was unchanged at $3.086 a gallon.

Black Friday kicks off the holiday shopping season

Black Friday got off to its earliest start yet as the nation's shoppers put the turkey down to take advantage of stores' expanded hours.

Stores typically open in the wee hours of the morning on the day after Thanksgiving that's named Black Friday because that is when they traditionally turn a profit for the year. But Black Friday openings have crept earlier and earlier over the past few years. This year, crowds gathered across the country as stores from Target to Toys R Us opened their doors as early as Thanksgiving evening.

Business confidence rises unexpectedly in Germany

BERLIN (AP) ? A closely-watched survey has found business confidence in Germany unexpectedly rising this month following six straight declines.

Munich's Ifo institute reported Friday that its key business climate figure rose to 101.4 points in November from 100 in October. Economists had been predicting a modest drop to 99.5.

Germany's economy, Europe's biggest, has recovered strongly from its deep recession in 2008-09 despite the mounting debt problems on its doorstep. However, there have been recent signs that its export-driven economy is beginning to slow amid weakening demand from other countries.

Earlier this month, the German government's panel of independent economic advisers forecast that the economy will grow by only 0.8 percent this year and next.

Supreme Court To Consider Workplace Harassment Rules

By Terry Baynes
Nov 23 (Reuters) - The U.S. Supreme Court on Monday will hear arguments in a case that could determine when a company is liable for harassment by its employees.
The case turns on the definition of a single word - "supervisor" - under a federal civil rights law that prohibits racial, religious or sexual harassment in the workplace.
Under previous Supreme Court rulings, an employer is automatically responsible if a supervisor harasses a subordinate. The employer is not liable if the harassment is between two equal coworkers, unless it was negligent in allowing the abuse.
Since those rulings, a rift has developed between federal appeals courts over exactly who is a supervisor. On one side, three circuits say supervisors are those with the power to hire, fire, demote, promote or discipline. Three other circuits have adopted a broader standard, one that also includes employees who direct and oversee a colleague's daily work.
In the current case, Maetta Vance was the sole black catering worker at Ball State University in Muncie, Indiana. After filing numerous complaints with the university over racially charged incidents at work, she sued the university in federal court in 2006. She claimed that several white coworkers used racial epithets, references to the Ku Klux Klan and veiled physical threats against her.
In trying to hold Ball State liable, Vance's lawyers argued that one coworker, Saundra Davis, was a supervisor because she had the power to direct her day-to-day activities. Davis did not have to record her time, like other hourly employees, Vance argued. But the district court dismissed the case before a trial, finding Davis lacked sufficient authority over Vance. It also found that Ball State had taken corrective action and had not acted negligently.
The 7th U.S. Circuit Court of Appeals, in Chicago, reached the same conclusion, reasoning that Davis did not have the power to change Vance's employment status, and therefore the university was not liable for Davis's conduct.
Vance petitioned the Supreme Court.
Before deciding whether to hear the case, the Supreme Court asked the Justice Department for the government's position, as it does in some cases. U.S. Solicitor General Donald Verrilli agreed with Vance that the 7th Circuit's narrow interpretation was wrong, but also argued that this wasn't the best case to decide the issue, given what it saw as weak facts that Davis was Vance's supervisor. Vance presented no evidence of tasks or instructions Davis gave her and even said she was uncertain whether Davis was her supervisor, the government's brief said.
The Supreme Court accepted the case anyway.
Ball State has made the same argument as the government. Davis "would fail to qualify as Ms. Vance's supervisor even under the broader interpretation of that term applied by certain courts of appeals," university spokesman Tony Proudfoot said in an email, citing the Solicitor General's brief.
But Daniel Ortiz, a lawyer for Vance, said that under the broader standard there is evidence Davis was a supervisor.
Davis, who Vance believed was her supervisor, "taunted her with racial epithets, slapped her at one point and made her life a living hell," Ortiz said.
Business groups, including the U.S. Chamber of Commerce and the National Federation of Independent Business, have filed briefs supporting the narrow definition of supervisor used by the 7th, 1st and 8th Circuits.
Adopting the narrower definition allows employers to easily identify employees who would trigger automatic liability so they can be screened, trained and monitored, the business groups argue.
The open-ended definition, used by the 2nd, 4th and 9th Circuits, offers little guidance or incentive to undertake prevention efforts, the U.S. Chamber said in its brief.
Camille Olson, a lawyer at Seyfarth Shaw who represents companies, said if the Supreme Court adopts the more expansive definition, employers will be potentially liable for the conduct of a much larger pool of employees.
"The expanded definition of whose conduct binds the employer will significantly increase litigation for employers," said Olson, who is not involved in the latest case. Employees may also have less incentive to report harassment promptly and to get any immediate issues fixed, opting instead for litigation, she said.
The broad definition of supervisor would also conflict with a narrower one used in the Fair Labor Standards Act and National Labor Relations Act, creating confusion, she added.
On the other side, plaintiffs' lawyers say the stricter standard ignores the practical reality of the workplace and allows discrimination and harassment to go unpunished.
"The ones most likely to engage in harassment are the ones who deal with their coworkers day-to-day but may not have the special power to hire, fire, promote or demote," said Matthew Koski, an attorney with the National Employment Lawyers Association, a group for lawyers who represent workers.
Supervisors who make final employment decisions may be in a different office or a different state, he said.
The case is Vance v. Ball State University, U.S. Supreme Court, No. 11-556. (Reporting by Terry Baynes in New York; Editing by Eddie Evans and Prudence Crowther)

Workplace Training and fire-safety guide | Nil2Million

For a business to be safe and legal there is a list seemingly a mile long of things it must comply with ? and fire training and safety measures are no different.

While risk cannot be removed from life it is the responsibility of a business to minimise it and make sure staff and customers alike are as safe as can be.

Effective fire training starts with a risk assessment of a company?s building and all fire training and emergency procedures should be created around it.

There is no one fire procedure that will fit all business types or buildings as the evacuation plan for a large manufacturing plant is massively different to that of a small corner shop.

Fire training for staff should include what they need to do on discovering a fire and how to raise the alarm in such an emergency. Staff also need to be certain of what do to should a business be open to members of the public. They need to be able to confidently and calmly direct customers to safe escape routes and emergency exits.

It is important that senior members of staff take care of the more critical roles and one such role is that of a fire safety officer.

The fire safety officer is responsible for making sure all fire fighting equipment is in working order and available in all the correct locations. They also need to make sure all alarms are working and in the places they are needed throughout the premises of a business.

If they are short they can order more fire detectors and smoke alarms from fireprotectiononline.co.uk or somewhere similar.

It is easier to prevent fires than it is to fight them and one of the best bits of training you can give any work force is good housekeeping.

If you are working somewhere with machines that run hot, or anything that involves a lot of heat it is vital to keep the work place clean. Pieces of cardboard and collections of dust can ignite easier than most people think in these environments, so it is important to keep machines and the areas around them clean.

Staff should also be trained on how to isolate machinery should they think there is a risk, along with being taught to store flammable and hazardous substances correctly to minimise risks.

Finally, all staff in the emergency plan that have a supervisory role in case of fire should be given further details of a fire risk assessment and? receive additional training so they are fully prepared in an emergency.

Embracing shale gas may help cut emissions

Fred Pearce, consultant

108179246.jpg(Image: Mayumi Tera/Getty)

THIS book will anger many environmentalists. In it, Dieter Helm argues that they, and green-minded political leaders, have wasted two decades in counterproductive efforts to curb climate change, and he calls for climate crusaders to get behind the much-hated new fossil fuel, shale gas.

A University of Oxford economist with a distinguished pedigree on climate change, Helm is no closet sceptic. He is adamant that action to halt global warming is urgent. But he says that the dogged installation, especially in Europe, of expensive and poorly performing wind turbines and solar panels has done more harm than good.

Far from kick-starting a renewables revolution, he says, it has diverted cash from research and design needed to produce genuinely carbon-reducing energy technologies. Worse, it has pushed up energy prices and driven industries to relocate. "What exactly is the point of reducing emissions in Europe," he asks, "if it encourages energy-intensive industry to move to China, where the pollution will be ever worse?"

The most urgent need is to banish coal burning, he says. Any other fuel is better. And the clear choice for the immediate future is natural gas, especially shale gas.

Natural gas may contain carbon, but burning it in power stations produces only half the carbon emissions of coal. And, thanks to improved drilling technology, we suddenly have huge reserves of cheap shale gas available around the world.

Greens may recoil at the idea of yet more cheap fossil fuel. But the US's dash to exploit shale gas cut its carbon emissions by 1.7 per cent in 2011, at a time when Europe's emissions rose. Why not grab this carbon lifeline?

Helm acknowledges that there are plenty of places where shale gas exploitation would be environmentally damaging, and that it is only a "bridging technology". But, he says, calls to stifle shale gas at birth are born of economic illiteracy. A ban can only push up coal production, the worst of all possible outcomes.

His stance is controversial, and there are those who argue shale gas will actually squeeze out renewables. But Helm insists that this is both the cheapest and quickest way to cut emissions.

The Carbon Crunch is a powerful and heartfelt plea for hard-nosed realism. And it also suggests a worrying truth - that the environment movement is often more interested in pursuing a soft-focus vision of a greener world than in actually fixing climate change.
