Oracle v. Google: Judge finds structure of Java APIs not copyrightable, renders jury infringement verdict moot

Image

Thought the Oracle v. Google litigation fireworks were over? Well, if you weren't aware, during the copyright phase of the trial, the jury found that Google had infringed the structure, sequence and organization of Oracle's Java APIs. However, at the time, Judge Alsup had yet to evaluate the validity of Oracle's API copyright claims upon which that verdict was based. Today, Alsup found that Oracle's argument didn't hold water because it would expand the breadth of copyright holder's rights too far -- in essence, it would allow owners of software code to prevent others from writing different versions to perform the same functions. This ruling renders the jury's earlier infringement verdict moot, and gives Mountain View yet another courtroom victory. Despite this latest defeat, Oracle's sure to run the case up one more rung on the legal ladder, so let the countdown to the appeal begin.

Insurance Agents: Agents of Public Health | InsuranceFiles

May 30, 2012

The insurance industry does not always have the best reputation. Relatively small companies holding huge amounts of wealth tend to make people nervous and uncomfortable, especially during economic recessions, and with companies given the same rights as individuals, there is naturally a public backlash against powerful companies.

Despite the fact that amassing wealth is by no means illegal (if it is done legally of course), the mere fact that there are people who are still prosperous financially when so many are suffering makes any company an easy scapegoat.

But even with an image issue that can easily dictate the profits and losses until the recession blows over, the way that the insurance industry has been constructed to work for the public good.

Insurance companies make money when policies are written. This is when customers pay their premiums and companies get a small influx of capitol. But when customers make claims and companies have to pay these claims, insurance companies lose money. So it is in an insurance company's best interest to prevent accidents that would cause customers to submit claims.

Therefore, insurance companies and those who promote public health and safety make for a natural alliance because it is in both parties' best interest to keep the public safe.

The goal of public health, as an entity of the government, is obviously to keep the public as safe as possible. This goal is reflected in laws passed after years of testing and often a public outcry. For example the seatbelt law requires everyone in a car to wear a seatbelt and the no smoking in restaurants law was put in place to mitigate the effects of second-hand smoke, just to name a few.

The passing of these laws has had major benefits for all types of insurance companies. After the seatbelt law was passed, fewer people were seriously injured or died in car accidents meaning that insurance companies have to pay out less money.

The same principle works for the anti-smoking law and health insurance companies. Fewer instances of the type of cancer that smoking causes mean fewer bills for health insurers. Naturally, the health and safety of the general public benefit from these laws, but also for insurance.

Certainly these types of policies benefit insurance companies much more overtly than independent insurance agents, but in an industry that is so centered on reputation, showing the public that insurance is really on their side and profits off of the public's well-being and not their losses will only help every aspect of the business, including agents.

Is anyone else disturbed that such an incredibly major change happened only 20,000 years ago?

This could be worse than an ice age.

No. If, 20,000 years ago, it was much more active, it proves living in a galaxy with an active nucleus is not a problem. What it means is, if it becomes more active again, we don't really have anything to worry about -- we've been living with the "problem" for most of five billion years and gotten along just fine...

4 Steps to Successful Virtual Team Building | Noobpreneur Business ...

virtual team tips

Tips on successful virtual team building

Outsourcing and running a company that operates on several different continents is a situation that is becoming more and more common every year. When working in a so-called ?virtual office? in which the employees are communicating via the Internet while sitting in offices that are located thousands of miles away from one another, the concept of team building might seem a little farfetched.

The fact that there is so much distance between them, they are operating in completely different time zones, they rarely talk to each other face to face, often speak different languages, and the fact that they are from different cultural backgrounds could make team building a little more difficult than what was expected?

However, it is certainly not impossible.

Here are four key steps for successful team building in a virtual office.

Building Respect

The way to build respect in a virtual office is to allow all of the employees to get to know each other ? not only personally, but in terms of what each member of the team does. The office leaders should take the time to introduce all team members to one another and let everyone know what each member of the team does, what makes them special, and why they are vital to the team.

When an employee sees that the team leaders are fully aware of what he or she does and that they understand the strengths of each team member, this recognition feels very rewarding and empowering. Better still, if the team leader feels the need to let everyone else know why each employee is part of the team and takes the time to introduce everyone in a very thorough and respectful way, it brings the group together. A little flattery can never hurt. If every employee knows that he or she is appreciated and all the employees know what everyone else does and is responsible for, they immediately feel like more of a team than when they were just introduced to one another via an email or Skype conversations.

Building Trust

Trust is something that needs to be earned. This has never been truer than in the business environment. If you say that you are going to get a project done before the deadline, then keep true to that promise. If you treat your colleagues? requests with ?I?ll get to it when I get to it,? type replies, no one will ever trust you to get the job done in crunch time.

If you have a good track record and you show yourself as someone who gets things done on schedule, then you become a trusted worker. Make sure that everyone in the virtual office is aware of this and enforce deadlines and time frames very strictly. It is important to set the same standards for all of the employees, regardless of what country they might be located in.

Building Communication

Communication is the best way to build friendships, and building friendly relationships is a big part of team building. Encourage your team members to add each other on Facebook, follow each other on Twitter or communicate regularly on Skype. Since it?s impossible to organize sporting events or picnics for a virtual office, get creative. Set up Facebook groups where your employees can talk about non-business-related things after hours, set up Skype groups in which employees can casually chat, or send each other funny pictures while working. Having an all business, no fun attitude has never been a part of team building, and it is an even worse idea when you are running a virtual office in which you have no way of getting everyone together for after-work activities.

You need to make some compromises on the Internet communication rules when working with virtual offices, because that is the only way in which your team members are communicating. Give them some slack on off-topic Internet activity and casual chatting in order to enable them to get to know each other and become comfortable with one another.

Building Understanding

This is probably the most important thing of all. If one of your colleagues does not speak your language as well as you would like them to and you are having a hard time understanding them, don?t get angry at them or insult them. Have patience and have understanding for the fact that this is not their native language. Working in a virtual office means that you need to put in a lot more effort as far as inter-personal relations are concerned.

Understanding that you are working with people who come from a different culture and place than you is essential for team building in such a situation. Remember that if you are showing understanding for someone else, that person will likely reciprocate the effort.

It is a well-known fact that many people work this way in order to decrease their overhead and save money, but team building within the setting of an international, virtual office can also improve output and increase productivity in a setting in which procrastination and wasted work hours are a lot harder to control and avoid than in regular office situations.

Kevin Rushing, Former Marine, Helps Bring Gaming To Detroit

Detroiter Kevin Rushing wants to use his gaming business, Krush Industries, in order to form a tighter-knit, collaborative community for young adults in the city. But the veteran is drawing on an unlikely source: his experience in the Marines.

"A lot of this came out of my experience coming home as a civilian with PTSD and finding more therapeutic ways to live and healthier lifestyle options," said Rushing, who went to Iraq with the Marine Corps in 2003 and 2004 . "I really think of games as the absolute opposite of warfare, it's collaboration."

The business, which Rushing launched with his brother last year, "started with an idea called 'Big Fun Place.'" The siblings wanted to bring gaming to Detroiters who were looking for new forms of entertainment.

"We don't really want to party hard, drinking and smoking and stuff ... there's a lack of entertainment options for young adults that are healthy and engaging," he said. "We started coming up with events and spaces that were appropriate and cool enough for adults."

As part of their mission, Rushing and his brother recently organized punk rock dodgeball at the Russell Industrial Center, and started trying to raise funds for an assault course based on the '90s television show "Gladiators."

The Rushings also received a CAMP Detroit grant to create an installation, called the Krush Arcade Experience, that will debut at this weekend's Movement Electronic Music Festival and will appear at other city events in the future. It is an arcade machine emulator loaded with old school arcade games, in a tent filled with lights and lasers for an '80s vibe.

"We both really love Detroit and are passionately involved in making it a successful community," Rushing said.

The veteran's ideas are also backed up by recent research, which has suggested that playing video games like Tetris may minimize flashbacks and other psychological symptoms following trauma.

Though the brothers plan future Krush Industries projects, Rushing is also digging into the psychology of gaming and its role in society. He's interested in how elements of gaming, like competitions and receiving incentives for completing tasks -- such as getting points for spending money on a credit card -- can be used in daily life.

"Entertainment will have to be more engaging and thoughtful," Kevin said about his vision of the future of Krush Industries. "There's an ethical portion to this and a community-forward portion that we think will make it more than just an entertainment facility."

For Rushing, his dedication stems from his positive experience with gaming, whether in training competitions with the Marines, arcades or Gladiator challenge courses.

"The thing about playing games and competing," he said, "is you lose yourself in it."

Instagram grew 78 percent in April, but where does it fit into Facebook?s plans?

    instagram

Instagram saw a dramatic boost to its traffic between the months of March and April thanks to news of its Android app debut and acquisition by Facebook. But is it possible that Instagram plays a larger picture in Facebook's rumored foray into the production of its own smartphone?

There?s one thing that Facebook can boast in the wake of Zynga?s acquisition of Draw Something: Its acquisition of Instagram didn?t result in the app?s death. In fact, Instagram?s performance solidifies its prominence in the camera app market. ComScore has revealed that Instagram has been the top performing Internet property with traffic increasing by a whopping 78 percent between the months of March and April 2012. That?s great an all, but what does Facebook have planned for its acquisition? And what is its underlying motivation?

Note that these comScore figures aren?t a true indicator of Instagram?s performance, as it only takes into consideration the mobile app?s Web presence. While its success would be best measured by the number of downloads and active users, it?s evident that a number of high-profile announcements factored into April?s jump. The long awaited debut of its Android application on April 3 opened the flood gates to an untapped market of Android users. And, of course, the last-minute $1 billion acquisition of Instagram by Facebook likely helped as well.

While April was a significant month, we shouldn?t expect the same dramatic growth in the coming months; Instagram is currently awaiting the Federal Trade Commission?s investigation into a possible anti-trust violation by Facebook. The issue could take up to six months to resolve. More importantly, Facebook?s announcement of its own Instagram competitor, Facebook Camera, could spell trouble for Instagram. Plus, as our readers have indicated, Facebook may not have Instagram?s best interest in mind. Facebook?s focus on its products?will remain on its Camera app, while Instagram may be neglected seeing as how it?was most likely a user?acquisition.?

So where will Facebook?s Instagram users be leveraged? While Instagram has grown its user base to 50 million users, Facebook?s rumored plans to acquire?Opera, and its launch of an app store and Messenger app, clues us into Facebook?s motives for Instagram. While we speculated that Facebook?s Camera app launch may have been motivated by its poor NASDAQ opening, which to an extent has merit as a PR stunt, Facebook?s motivations appears to run deeper that.

It?s not hard to realize that the social network is looking to extend some of its core features into mobile apps we?ve discussed before. But here?s where we get speculative. It?s entirely plausible that while Facebook is slowly developing its mobile experience for users with new Facebook branded apps and increasing its brand presence on mobile phones, the company is slowly preparing for its first horizontal integration via the rumored Facebook phone. After Facebook has comfortably developed and grown its core suite of Facebook mobile applications, while at the same time maintaining?acquisitions?including Instagram, we could expect these apps to be ported over to the Facebook phone, and displayed as Facebook?s native applications. Thanks to Instagram that could mean the potential for 50 million Facebook phone owners. Or there?s always the possibility that Instagram could be enveloped by Facebook Camera, although that may be a stretch.

So if our speculations have a semblance of merit, we?re going to see more mobile app acquisitions by Facebook as part of a calculated?move into a horizontal business model. After all, in its current state, Facebook is merely a social network. To achieve Google?s prominence and notoriety, Facebook needs to expand its business and evolve from its standing as just a social network.

Ford says Sync is now in 4 million vehicles, takes a moment to talk up Focus Electric

Since its debut in 2007, Ford and Microsoft's Sync infotainment system has made its way into several of the auto maker's models, including the 2012 Focus Electric. At this week's Future in Review tech conference, Ford announced that more than 4 million vehicles in the US have its entertainment platform on board. In addition to dropping that stat, the company talked up its new EV, which it says can charge in half the time it takes for the Nissan Leaf. Maybe Ford caught wind of Nissan's just-announced e-NV200 all-electric van and wanted to remind those in the market for an EV that a blue box isn't the only option.

What the Friday: Good luck eating this 18,239-pound chocolate Mayan pyramid

You only have until December 21 to see it for yourself... whether the world is ending or not

We can't get enough of chocolate. Not only does it taste heavenly, it also?makes great dresses, vinyls, and apparently, even pyramids. Chocolate and pastry distributor,?Qzina Specialty Foods, celebrated its 30th year anniversary this 2012 by building the largest chocolate sculpture ever. At 18,239 pounds, it's more than 7,500 pounds heavier?than the previous Guinness World Record record holder. We bet not even the most hardcore chocoholic can make a large enough dent on that thing.

The humongous choco art is a replica of the?Kukulkan pyramid in Chichen Itza, an archeaological site in Yucat?n. It measures 6 feet in height and sits on a 3,000-pound, 10 feet x 10 feet base.?According to Qzina, it chose to a Mayan theme for the project because the Mayans were the first civilization to realize the awesomeness of cacao beans, and even thought of them as food for the gods.

If you want to get a glimpse (and perhaps a secret nibble) of this chocolate pyramid, head over to the?Qzina Institute of Chocolate & Pastry in Irvine, California, when it becomes available for public viewing starting June 4. And because a chocolate pyramid can't survive for thousands of years like a real one, Qzina scheduled its destruction on December 21, 2012... assuming the world doesn't end by way of a great flood, an asteroid, or a?zombie takeover first.

How To Invest In Real Estate With Better Revenue Prospects | Free ...

Consider this thought of wisdom: If you purchase and use a certain product or service regularly, why not make an additional benefit from it by being a seller of this item, as well? The profits you get in buying and selling the items which you yourself make use of could at least provide for your own usage of that product often.

    ?

You possibly will not have regarded it exactly the same way but when you acquire your own property on a loans deal, you might want to consider participating in a real estate buying and selling business. The earnings you?ve made here could very well provided for your own monthly home repayments and much more, if you genuinely make a profession out of it.

    ?

Should you think about yourself for some reason an all-natural salesman then you?d better think about a more big items to get and sell for better earnings probability. Real estate investment features much bigger profits with basically identical effort as well as capital as other business investments call for.

    ?

Now that you are sure with this a lot more advantageous income-generating potential, the next matter you may want to know is how to invest in real estate. With real estate?s large profits prospects, the question to question is not ?what? but ?how.?

    ?

The very first thing you should put in place in real estate trading is the funding element. Not like marketing of superb goods, you don?t do bulk buys of real properties on wholesale price ranges and then sell these on a highly marked up price practically twice compared to cost of buying them. The best or drastically wrong financing offer could make or even break your real property investment business.

    ?

You should come to a decision also whether you want to make a long-term investment on the house you purchase by renting it or go for a more short term investment by disposing the properties in the real estate market once you buy it. The first choice provides for a longer and larger income-generating opportunity, as the real estate costs will hopefully increase with the passing of time. The second selection permits you quick earnings but not as important as the longer term investment.

    ?

Leasing your newly bought house would likely have the rental payments handle the month to month amortization you have to pay your financing bank. This would mean that when you lastly sell your price-appreciated property after a good number of years, the profit you make would be very substantial because the real estate property paid for itself with the repayment years.

    ?

If you have what it takes regarding courage, optimism along with patience, investing in real estate?on a a lot more long term basis might grant you better potentials} in making higher profits.

UN: Syrian forces, opposition committing crimes

GENEVA (AP) ? Syrian government forces and anti-government armed groups are both carrying out unlawful killings, torturing opponents and abusing children in the 15-month-old uprising, a U.N.-appointed panel of human rights experts said Thursday, though it underlined that security forces are still responsible for the largest share of the violence.

The findings by the Independent International Commission of Inquiry on Syria show a chilling pattern of abuses on both sides of a conflict that it says has become "increasingly militarized" despite U.N. cease-fire efforts. The report is based on hundreds of interviews since March with victims and witnesses who fled the country.

The three-member panel says the conflict has shifted and the government now faces armed and well-organized fighters bolstered by defectors. The widespread human rights abuses by government forces occur "most often during large-scale, military attacks on specific locations known for hosting defectors and other anti-government sympathizers," it says.

The report documents unlawful killings by government forces in Idlib, Homs, Aleppo, Hama, Damascus and Daraa and in numerous villages. It says a clear pattern has emerged in which an attack is preceded by a blockade of main roads in a neighborhood or village.

The panel also cites accounts of security forces using both precise shelling to hit opposition stronghold and indiscriminate targeting of residential areas where opposition fighters are believed to be hiding.

After the shelling, it says, security forces go in, backed by snipers on rooftops often using school buildings, and search house-to-house. The reports says that in some cases, suspects and others were executed immediately, according to repeated accounts.

"Fighters in anti-government armed groups were killed after being captured or wounded. In some particularly grave instances, entire families were executed in their homes ? usually the family members of those opposing the government," it says.

The reports says government forces have resorted to use of beatings and electric shocks on captured opponents and killed children by sniper fire. Children, including boys as young as 10, who have been detained by government forces, it says, have repeatedly said they are "tortured to admit that older male members of their fammly are Free Syrian Army? soldiers or supporters."

In March, a school in Atarib was occupied by government tanks, with snipers posted on its rooftop, and another school in a nearby village was burned down because of rumors its headmaster was an anti-government sympathizer, the report says. In April, the report says, a village school in Hama was used as a government command post with snipers on the roof.

The commission is chaired by Brazilian professor Paulo Sergio Pinheiro and includes Karen AbuZayd, who formerly headed the U.N. agency for Palestinian refugees, and Yakin Erturk, a former U.N. investigator on violence against women.

It has published previous reports on the conflict that the U.N. says has killed well over 9,000 people. In March, the commission handed U.N. human rights chief Navi Pillay a secret, sealed list of top Syrian officials who could face investigation for crimes against humanity carried out by Syria?s security forces against government opponents.

But, the report says there is a growing list of abuses committed by anti-government armed groups, including executions of military forces and suspected informers. It says the opposition has increasingly resorted to improvised explosive devices.

The panel says it has videotaped sessions in which captured Syrian government forces or supporters are seen confessing under torture, with signs of bruising and bleeding. Anti-government armed groups also have abducted civilians and government forces apparently for prisoner exchanges or ransom.

Children are also being used as messengers and cooks, or to deliver medical supplies to field hospitals. The panel says its staff met children who regularly traversed the Turkish-Syrian border. Four had earlier been injured by sniper fire.

Syria's main opposition council, meanwhile, said it has accepted the resignation of its Paris-based president who earlier offered to step down amid mounting criticism of his leadership.

The executive committee of the Syrian National Council asked Burhan Ghalioun to pursue his duties until a new president is elected at a meeting on June 9 and 10.

The SNC has been plagued by infighting and divisions since its inception in September, complicating Western efforts to bolster the opposition. Ghalioun's offer to resign came just days after he was re-elected for a third, three month term in a controversial vote in Rome.

How To Find Out If You Need Individual Vision Insurance?

For individuals with vision problems, imaginative and prescient insurance generally is a real life saver. When you consider that one has to spend wherever from a few hundred to a couple thousand dollars yearly on prescription glasses, contact lenses, and common eye visits, it makes quite a lot of sense to get vision insurance and drastically reduce down these costs.

Individual imaginative and prescient insurance coverage might be easily obtained through your employer. Most companies provide individual as well as group packages to insure not simply yourself but also your family. This can be a nice plan for families that have more than one individual with imaginative and prescient problems.

There have been instances when vision insurance providers haven?t lived as much as their promises and charged folks a whole lot of dollars by way of some clause within the high quality print of the contract. Subsequently, it?s endorsed that you fastidiously go through your policy and comb out any suspicious clause which will have you pay hundreds of dollars further for treatment.

Pay less than $20/month for Accident Insurance through insurance agency, wellnessplanusa.com, that will help pay for your deductible when you have an accident and are responsible for high out of pocket costs.

Points just like the one talked about above make many people suppose whether or not individual vision insurance coverage is even a justified expense. After all, a coverage costs around $15-20 every month. If you have just mild imaginative and prescient issues, can care for your contact lenses/prescription glasses (i.e. you?ll be able to handle not to break/lose them), then your complete expenses for therapy every year may be just around the bills on a vision insurance coverage policy. For such folks, it might make financial sense to not buy such a policy.

However for others who?ve extreme vision problems or carry on losing/breaking their prescription glasses and contact lenses, particular person imaginative and prescient insurance can reduce down the costs drastically. You may literally save a whole lot of dollars, especially on prescription glasses and make contact with lenses, which usually value a whole lot of dollars.

In the long run, you need to sit down and analyze your whole bills yearly on vision related problems. If it is more than $a hundred and fifty, then by all means, go for a vision insurance policy.

Recreational fees bounced around - The Barrie Examiner - Ontario ...

Councillors meeting today to discuss ways to offset recreation costs through user fees

By Bob Bruton - Barrie Examiner

    Posted 16 hours ago

The city is walking, if not yet running, toward greater cost recovery for Barrie recreation programs.

Councillors will meet and discuss measures today from city staff about a six-year strategy to recover 70% of recreation program costs through fees. The average now is 50%.

?It gets back to the question ... what is appropriate for people to be paying for in their general taxes and what is appropriate for people to be paying for on a user-basis?? Mayor Jeff Lehman said. ?If you use a program, you pay for it.?

?I think the principle of moving closer to a user-pay model makes sense for most people in a number of areas and services. The reality is at the end of the day someone has to pay the bill,? said Coun. Michael Prowse, chairman of the city finance committee.

?If the people using the program don?t pay for it, then we have to forward the bill to all of our residents through property tax increases,??he added.

Lehman says there?s a wide range of city subsidy on recreation programs ? everything from aquatics and fitness to day camps, skating, dance and minor sports.

?Right now, we?re all over the map,? he said. ?There are some things the City of Barrie subsidizes very, very heavily, where the general taxpayer is paying for certain kinds of recreation programs that a lot of people get a lot of benefit from. But we?re subsidizing the vast majority of the cost.

?There?s other areas, like fitness, for example, where we are pretty close to cost recovery already.?

Lehman says staff have done the first across-the-board report on how city recreation programs are paid for, factoring in facility costs as well.

The subsidy level for aquatics, for example, is 30% ? but factor in the facility and it jumps to 64%. Skating programs are almost entirely user-pay, with only 1% subsidy ? until the arena is counted. Then subsidy jumps to 70%.

Fitness programs are only 6% subsidized, and 94% user-pay, until the facilities become part of the equation. Then subsidy hits 42%.

?There?s never been a comprehensive look at this to say, these are the kinds of things we should subsidize very heavily because we want people to participate and we believe it has community benefit to keep the costs very low,? Lehman said.

He lists swimming lessons, for example, because Barrie is a waterfront city, right on Kempenfelt Bay. It?s safer if people can swim, so the cost for swimming lessons should be low.

?We subsidize kids sports quite heavily, generally,? Lehman said. ?My own opinion? That?s a good decision. We want to keep doing that, we want to encourage participation in youth sport as much as possible, for all kinds of good reasons.?

Lehman noted the registration fee is just one part of the cost of kids playing sports, and that equipment can be expensive, too.

Lehman said there might be other examples where the city is competing with the private sector, such as ballroom dancing, and the city subsidy could decrease.

?It?s also a legitimate question about whether we are undercutting the private sector,? he said.

Prowse said while the city wants to create and foster a healthy environment for all Barrie residents, he doesn?t believe that can only be done through full subsidies or giving away a service.

?In general people will pay for something they believe has value or provides a benefit,? he said. ?While you could make the argument you might get more people in your classes, courses and recreation facilities by simply giving away the product, I believe you can also get higher participation and a greater cost recovery through improving your product and controlling your costs at the same time.?

But increasing user fees and trying to attract more people to recreation programs could also be at odds.

?If you charge more for anything, some people are going to find that too expensive and are not going to use it,? Lehman said, ?so right off the bat we have to be very, very careful at any time when we increase user-fees when we are trying to increase participation, regardless of what that is.

?It?s possible one result of this strategy will be there are certain areas we want to subsidize further or maintain the high level of subsidy and not touch the fees at all.?

Prowse said city council set an initial 70% cost-recovery target, but there are other decisions to be made.

?I am sure that as we work through the process, there may be changes in that target as we evaluate how and the bigger question ?if? we should be delivering tomorrow the services that we do today,? he said.

And the winner of 'Dancing With the Stars' is ...

    Getty Images

Season 14 finalists William Levy, Katherine Jenkins and Donald Driver.

    By Ree Hines

As a football pro, Donald Driver knows a thing or two about how to play a game. It doesn't matter if you're down in the first half -- or even the first three quarters. What matters is where you land when the game's over. And when the clock ran down on Tuesday night's "Dancing With the Stars" finale, the Green Bay Packer was the clear winner.

After spending most of the season trailing just behind his fellow finalists?William Levy and Katherine Jenkins, Donald closed the gap (and then some) in the finals. A solid judge's pick routine on Monday night and his 24-hour-prep performance in the finale helped him, but it was no doubt his show-stopping, country-themed finals freestyle that sealed the deal when it came to viewer votes.

When the results were announced, Donald threw himself across the dance floor, as he's been apt to do during high-points all season long. Then host Tom Bergeron turned to the wide receiver and said, "I've got to ask you the question that Brooke (Burke Charvet) always asks: How do you feel?"

Completely ignoring that Brooke zinger, Donald raved, "Amazing! Oh, this is awesome! Thank you so much."

The victory was a sweet one for the man who spent much of the season hoping (and rehearsing) for a single perfect score from the panel -- and more importantly, from head judge Len Goodman. Donald regularly wished for a "10 from Len," and in the final 24 hours of the competition, he boasted two of them and a sparkling mirror ball trophy too.

Of course, the win wasn't just a victory for Donald. His partner, Peta Murgatroyd, is now a "Dancing" champ. After exiting the game in the first week during her premiere season, she took it all the way with Donald in her second effort.

    Adam Taylor / ABC

Donald and Peta's win wasn't the only one of the night. OK, technically it was, but Donald's fellow finalists put on some praise-winning, if not show-winning performances.

First William, who ended the night in third place, took the floor for a salsa. It was a bold choice for his final routine after getting an earful from Len for performing a salsa-filled freestyle the night before. His last effort wasn't as polished as his earlier ones, but it still packed the hip-shaking and rear-rotating moves he's now known for.

Then second-place finisher Katherine took the floor for a jumping jive that earned raves from the panel. According to judge Bruno Tonioli, the dance only cemented the fact that she's "the girl that has it all."

Well, everything but a mirror ball trophy.

Donald's last-chance cha cha -- easily the best dance of the night, other than maybe his encore freestyle -- proved his win was well earned. The routine packed body rolls, smooth transitions and fan-pleasing perfect lines.

All the dances earned top scores from the panel.

And those weren't the only performances of note. The ballroom's past challengers of the season came back to remind the crowd just what they could do. Highlights included Sherri Shepherd's "It's Raining Men" routine, complete with pros Maksim Chmerkovskiy and Tony Dovolani raining from the ceiling while she took one last spin with Val Chmerkovskiy. And Melissa Gilbert hit the floor again with both Brothers Chmerkovskiy for a reworking of her memorable trio routine.

Roshon Fegan had the chance to show viewers what his freestyle would have looked like had he made it to the finals. The fast, content-packed dance was worth watching, but it seems a safe bet to say Donald would have still won that round.

But one of the most memorable performances of the night came from a not-so-great dancer -- Gladys Knight. The singing legend traded her dancing shoes for a microphone and belted out a tear-jerking rendition of "Memories" while the finalists awaited the results.

That (and a whole lot of star-studded, clip-tastic filler) was all the two-hour finale could pack. But as Tom reminded viewers, the ballroom bash will be back in the fall with an all-star season bound to entertain fans once again.

What did you think of the finalists' last dances? Which returning star had the best performance? Share your thoughts on our Facebook page!

zocdoc2This morning at TechCrunch Disrupt NY 2012, Chris Dixon, co-founder and partner at Founder?s Collective (and co-founder of SiteAdvisor and Hunch, acquired by McAfee and eBay, respectively), sat down with ZocDoc CEO Cyrus Massoumi to talk about ZocDoc's road to success. The company, for those unfamiliar, is a professional booking platform for doctors. Users go online to search, find and book a doctor, dentist or other health care professional, and can even make same-day appointments thanks to ZocDoc's real-time access to doctors' schedules. Although ZocDoc has now raised $95 million in funding to date, it didn't necessarily have that many early believers.

Causes and Treatments for Hearing Loss - Health and Fitness

Our ears sport an important role in our everyday lives. As time passes, our sense of ~ ability decreases because of many causes.

Sense of ~ is a process of sound. Your ear is divided into three talents: first is the outer ear where you pick up sounds, sending it to the mean ear, where the eardrum starts to vibrate, impelling the bones and helping the sound travel into the interior ear, where the sound processing starts. Howsoever, if something wrong happens in one of these processes, that?s at the time you experience hearing loss.

Causes of Sense of ~ Loss

Hearing loss may be caused by fluids that stay in the ear subsequent to an ear infection; these causes are common in greatest in quantity people. Other causes of hearing privation are: the buildup of earwax, a scar or a hole in the eardrum from spent ear infections, or foreign objects that is stuck interior the ear.

Some causes of hearing loss can be at hand at birth, like birth defects that changed the stipulations in the ear; some could come from genetic stipulations and infections that came from the female parent that has been passed to the child in the uterus that can also cause changes in the ear (examples: toxoplasmosis, rubella, or herpes). In that place are other infections that can affect the nerves of the ear like; rubeola, mumps and scarlet fever.

Our ears can likewise be injured from pressure difference. This happens at the time the pressure from outside the eardrum is distinct from the pressure inside the eardrum. This is frequently experienced from scuba diving.

Other causes can be exterior forces that damages the nerves in our ears like explosions, gunfire, resounding noises and skull fractures. Other causes are age-connected, the use of certain medicines, and too much exposure to resounding noises.

    Hearing Loss Treatment

Usage from hearing loss is not that low-priced and not easily attained so I would suggest avoiding the causes of sense of ~ loss. But when loss of hearing seems unavoidable, you could only turn to treatment. Treating sense of ~ loss depends on the type of hearing privation. Common treatments include medicines, operations, and sense of ~ aids.

Hearing aids are like amplifiers, they create the sound easier to pick up so that the whole could be clearer to someone who has loss their sense of ~. But hearing aids are expensive and they get easily shattered, they are not water-resistant, and could rend easily when stepped on. If you?re not able or inclined to spend the money on custom devices, you may deficiency to consider over-the-counter hearing aids. At the time you decide to get a hearing aid, you can also check into sense of ~ aid insurance.

Hearing aid insurance gives you a stipulation period of 2-3 years, which certainly guarantees you protection from any sudden privation or damage. However some insurance companies do not present hearing aid insurance as part of their soundness insurance plans because hearing aids do not drop in the category of prosthetic devices; some companies add-on an additional charge when it comes to hearing aids.

Our sense of ~ is important and should be paid attention to. In following more rules and researching on solutions to enhance our sense of ~, we are a step closer to preventing loss of sense of ~.

How?s your hearing? If you find you have sense of ~ loss, but are not ready to get custom devices, take a direct the eye at over-the-counter hearing aids. They are far smaller expensive, and can help you hear well, at smallest in the short term.

    Scientists find gold-plated fossil solution

    Tuesday, May 22, 2012

An international team of scientists in the University of Leicester's Department of Geology has found a solution to a research problem involving fossils right next door - in the University's Chemistry Department.

Many objects, including fossils, can reveal a huge amount of scientific information when studied using the high power magnification of electron microscopes, but in order to study tiny fossils or microscopic details of larger fossils in this way, palaeontologists routinely coat the fossils with an ultra-thin layer of gold. This obviously changes the way the fossil looks, and so it is often necessary to remove the gold after analysis, but this is difficult and expensive and uses dangerous chemicals like cyanide.

University of Leicester chemists are developing industrial electro-plating and polishing techniques using liquid salts called 'ionic liquids' which are safe, cheap and environmentally friendly. Scientists from the two departments got together to see whether a similar process could be used on fossils. The work was supported by the Natural Environment Research Council (NERC).

They found that ionic liquids can remove gold quickly and easily without damaging even tiny, delicate fossils. The liquids are safe to handle, can be simply disposed of and can even dissolve the gold without affecting the glue that holds the fossil specimen in place for analysis.

Professor Mark Purnell, from the Department of Geology, said: "There are many cases where collecting the evidence required for research affects fossils or other objects in ways that might be considered as somewhat destructive ? gold coating for electron microscopy falls into this category. Understandably, this creates problems for places like museums which have to balance the value of research on their collections against the risk that specimens will be affected. This approach to gold removal offers a new way of tackling this problem that is safe for both researchers and the specimens."

Professor Andy Abbott, from the Department of Chemistry, added: "This is a very nice demonstration of the use of ionic liquids for metal recovery but it is just the tip of the iceberg as we are using this technology for the recycling of a wide range of alloys and waste materials. The University of Leicester is building a strong reputation for the development of sustainable materials."
